Class Action Lawsuit Filed Against Volkswagon

The 67,000 California Volkswagen diesel car owners – whose autos were part of the emissions-test rigging scandal might have chance at getting the German automaker to buy back their vehicles.

A class action lawsuit has been filed by a Seattle law firm in Los Angeles federal court – demanding an immediate buyback under California emissions laws.

“California law is quite clear that a manufacturer has a duty to refund or offer restitution if it can’t fix the issue,” according to lawyer Steve Berman who filed the suit.

It says Volkswagen executives have already conceded they can’t make the required repairs on most of the cars for at least a year or possibly longer and Berman says that obligates VW to take the cars back.

They are asking for an injunction hearing in November, and if they win, they want the refund program in place by the end of the year.

The vehicles in question emit up to 40 times the limit for smog-forming nitrogen oxide pollution.

Volkswagen faces a November 20th deadline to bring the fleet of diesels into compliance with California regulations.
