Judge Grants Temporary Restraining Order Over Tower Theater Sale

(KMJ) – A Wednesday ruling by a judge grants a temporary restraining order on the impeding sale of the historic Tower Theater.

The suit was filed by Sequoia Brewing Company, which says it should have been given the opportunity to buy the Tower District property first.  And it sights a clause in its lease that reportedly allows Sequoia “first right of refusal.”

The legal action was celebrated by the Save the Tower Theater Demonstration Committee who says finding this potential breach of contract gives it hope the sale of the site to Adventure Church will not go through.

But Tower Theater attorney David Camenson says that’s not the case.  He adds the judge’s decision to put a temporary restraining order is just a way to buy more time before a sale does happen.

However, the judge’s ruling does mean the owners of the Theater will not be able to sell it to Adventure Church until the court figures out Sequoia Brewing Company’s rights.
