Hearing Set For October in Immanuel Schools Fight To Stay Open During Pandemic

 

REEDLEY, CA (KMJ) – A private Christian school in Reedley is in the line of fire from California’s Attorney General..

On Sept. 15, a Fresno County judge issued a preliminary injunction against the school for violation of a state order by keeping their doors open to students during the pandemic.

Immanuel’s legal team says the school’s constitutional rights are being violated, and they have achieved herd immunity, they’ve kept the doors open.

 

Attorney General Xavier Becerra said the school is going against the state, the Fresno County Health Department and the order by the Fresno County Judge.

 

 

Ag Becerra was pushing for the judge to hold Immanuel Schools in contempt of court for failing to comply with the court order.

If found in contempt of court – Immanuel Schools could be forced to pay financial penalties, $1500 a day, for each day the order has been violated.

Immanuel’s lawyer said Fresno County is in the Red Tier on the state’s COVID-19 list, and schools can start reopening Oct. 13.

The judge ruled on Wednesday that the case would be heard, and both sides would offer their evidence on October 9, 2020.
