Court Upholds Calif. Location Restrictions on Gun Shops

FRESNO, Calif. (KMJ) — The U.S. 9th Circuit Court of Appeals has ruled that counties in the Golden State are allowed to restrict the location of stores that sell firearms.

An 11-judge panel has upheld an Alameda County ordinance, which bans gun stores within 500 feet of schools, day-care centers, residential areas, liquor stores, as well as existing gun shops.

Opponents argued that the ban violates the Second Amendment rights of would-be gun owners, and the rights of sellers’.

However, justices say the ordinance does not violate the constitution, and there is no right to sell firearms.
