Attorney: Fresno PD “Going Out Of Its Way” To Justify Fatal Shooting

FRESNO (KMJ) — The attorney representing the mother of a man fatally shot by Fresno Police, says he’s disappointed in the results from the internal affairs investigation into that incident.

Outside the Downtown Fresno Police headquarters, Stuart Chandler propped up a picture of the 19 year old who was shot and killed after an officer involved shooting in Fresno. His appearance came immediately after Police Chief Jerry Dyer wrapped up a press event inside, detailing what the internal affairs investigation had established (click here to read more).

The four shots came on June 25th 2016 after a call detailing a man with a gun. The responding officers then switched their focus onto a truck being driven by Dylan Noble after seeing it peel away. That chase led to a nearby gas station, and eventually ended with the four shots being fired and the 19 year old being pronounced dead in the hospital later that day.

“I’m disappointed that the Fresno Police Department is going out of its way to try to justify everything that was done and put 100% of the blame on Dylan”, began attorney Stuart Chandler. “I’m especially disappointed that there’s no accountability for failure to use less than lethal force along the way.

“Failure to address what I brought up in a press conference months ago about the availability of a canine, and less lethal options”.

Chandler questioned why tools such as a taser or pepper spray were not utilized.

“None of those things were used, and there was no discussion about what the Police Department had available to do something less than just shoot and wrongfully kill Dylan Noble”.

Chandler considers every one of the four shots fired at Dylan Noble to be wrongful.

“Then, when he was down on the ground, to suggest that the third shot was appropriate and even the fourth was justified but questionable is really an abomination to police practices. If we look at this and say ‘this is how the City of Fresno Police is’, there’s something wrong”.

He adds that they’re continuing to take steps to make sure it doesn’t happen again.

“We look forward to moving forward as quickly as possible with the civil litigation that’s now on file”.
