STOCKTON (Courtesy of KMJ's News Partner – CBS 13 Sacramento) — A woman who was taken hostage in a bank robbery and police chase – has now filed an injury claim against the police and the city where it happened.
Bank Of The West manager Kelly Huber was taken hostage during the armed robbery in Stockton on July 17th 2014.
"They would have left without Kelly or without anyone else – had the police not confronted them", says her attorney Michael Dyer. "They had robbed a place before and at the end they said 'we need car keys – someone give us your car keys' ".
He says Kelly Huber was initially only going to show the robbers where her car was. When a police officer drew his gun – they then took her as a hostage.
He adds that they could have used security systems already in place to determine what the situation was before going in.
"The bank has video cameras active at all times that they could have shared with police"
Kelly Huber was forced to drive her own SUV with the gunmen inside – and was shot in the leg during the chase.
Another hostage was killed at the end of that chase. Misty Holt-Singh's family add that they're aware of Kelly Huber's claim. The family say that it shows City of Stockton police officers violated numerous standard police protocols in their response.
