FRESNO, CA – Today, during the pretrial proceedings, the Court interpreted the lease agreement between the City of Fresno and Central Valley Community Sports Foundation (CVCSF) for the Granite Property, consistent with the City’s interpretation.
The parties stipulated that there was at least one material breach of the lease, which entitles the City to take immediate possession of Granite Park. As such, Judgment was entered in favor of the City.
The City pursued legal action following many defaults to include non-payment of billboard revenue, which the tenant admitted to during a deposition. In addition, CVCSF did not have appropriate insurance coverage to protect the City from claims arising from the tenant’s operation of the park.
“I’m pleased the judge validated the City’s position that CVCSF violated its lease,” said City Manager Georgeanne White. “I look forward to moving on from this saga and ensuring that Granite Park is a resource for our residents.”
It is anticipated that counsel for CVCSF will appeal and file a motion to stay on Tuesday, May 28, 2026. The City will file its opposition by June 3rd and a hearing on the motion will take place on June 12, 2026.
