
FRESNO, Calif. (KFSN) — On Monday, one of the teens accused in the killing of Caleb Quick last April arrived at the Fresno County Courthouse for a crucial court hearing, in which a judge must now decide if the girl will be tried as an adult or remain in the juvenile system.
“They need to show it’s a serious crime, that there was some criminal history here and there was some sophistication,” Action News Legal Analyst Tony Capozzi said.
The girl is accused of acting with her boyfriend. Investigators say she was the getaway driver of that white Tesla after the boy allegedly shot Caleb.
Prosecutors later charged both teens with murder.
“If they remain in the juvenile system, this is not a criminal case,” Capozzi said. “This is just a situation where they become a ward of the court. Every intent then of the court is to rehabilitate them to get them back into society.”
The transfer hearing is likely to be closed to cameras.
Inside on Monday were many of the girl’s family members. Some of Caleb’s friends, along with his mother and father, were also present.
“It’s going to be a very, very long week,” Caleb’s father, Steve, said. “All day, almost five hours.”
The transfer hearing is expected to last five days, beginning at 9 AM on Tuesday.
Prosecutors will present first, and the defense could begin its case on Wednesday. There will be up to 30 exhibits.
Attorneys on both sides are now in their final hours of preparation. They have filed paperwork with the court, ready for the judge’s review. It is “quite extensive,” she said.
As it all plays out, we have also learned that the attorneys for the boy, the chief suspect, will be in the courtroom preparing for his transfer hearing later this summer.
“I can assure you that the lawyers will order the transcript of every word that was spoken in that courtroom and all the evidence that came out, and analyze that before the hearing takes place with the male,” Capozzi said.
The girl will have a phone call with her parents.
