FRESNO, Calif. (KMJ) — Chuckling under his breath, former Fresno Deputy Police Chief Keith Foster listened as prosecutors played dozens of additional wiretaps Thursday, in which he can be heard communicating with co-conspirators Ricky Reynolds, along with nephews Denny Foster and Randy Flowers.
Foster can be heard arranging what federal agents say are deals to distribute oxycodone, heroind, and pot.
He became angry, when Denny Foster is busted with 6 pounds of marijuana, coming back from Shasta County.
Foster tells Denny’s girlfriend that he could have provided cover for his nephew, had he known what his plans were.
However, defense attorney Marshall Hodgkins claims Foster was working as an undercover narcotics officer at the time, and that Denny — a convicted felon — was working as a confidential informant.
Federal agents testified that such a scenario is unlikely, as relatives are essentially off limits as a C.I.
Foster — facing more than four decades in prison — is expected to testify at some point.
The trial enters day 4 on Friday.
