FRESNO, Calif. (KMJ) — Talking on your phone without a hands-free device or texting behind the wheel is certainly illegal in California, but what about scrolling through your music library or taking a photo of something interesting?
Nothing in state law says that’s illegal, primarily because the restrictions were written prior to modern smartphones.
However, Democratic Assemblyman Bill Quirk of Hayward, believes it’s time to get with the times.
He’s introduced legislation, according to the Sac Bee, which would make holding your phone while behind the wheel illegal.
If approved, you could only use your phone if it’s mounted to the dash or console.
Back in 2013, a Fresno County Superior Court ruled that using a smartphone to view a map is just as dangerous as texting or taking.
This latest effort to restrict smartphone use has the support of some in law enforcement, and thus far has minimal opposition.
