A former California Highway Patrol officer and his family are in a Fresno courtroom accused of helping a family member convicted of rape.
51 year-old Kyle Scarber, the former Assistant Chief with the CHP, his 53 year old wife, Gail and 35 year-old daughter Crystal Reynoso are appearing for their preliminary hearing on charges of aiding the escape of Spencer Scarber, now 23.
In December of 2012, a Fresno County jury found then 20 year-old Spenser Scarber guilty of raping a housekeeper at knife point at a home in Squaw Valley, in 2011.
Spenser Scarber had fled his trial and was captured later in Acapulco, then convicted of rape in February of 2014 and sent to prison.
His father Kyle accused of helping his son flee is now on trial.
Kyle had told KMJ News he had believed his son was framed, sex was consensual, and Spenser was forced into a false confession.
According to the judge, a half hour taped confession proved otherwise.
