A lawyer challenges the legality of a state order over water cuts.
Stockton Attorney Steven Herum represents farmers in two irrigation districts, and he’s filing for a third district, this week.
The California farmers he’s representing are considering whether to ignore a state order to make historic cuts in water use during the drought.
Herum says farmers received the curtailment notices but were not given a chance to speak out and there were no public hearings.
So Harum challenged the board.
“The State’s Attorneys said that it was not a mandatory requirement that instead it was a courtesy notice and had no law or effect and it did nothing yet the press release that was issued when the letters went out said that the farmer had to immediately stop pumping water.” Steve Harum, Attorney
Herum says the state needs to decide if its just an advisory notice or mandatory, and he says there could be further legal action.
